MEMO: Supreme Court Ruling on IEEPA Tariffs

Dear Clients,

The U.S. Supreme Court has ruled (6–3) that the International Emergency Economic Powers Act (IEEPA) does not authorize the President to impose tariffs. As a result, tariffs issued under IEEPA have been struck down.

At this time, there is no official guidance regarding removal of the tariffs, treatment of goods in transit, or potential refunds of duties already paid. Current reciprocal tariff remain in place until further notice.
While the IEEPA tariffs were invalidated, new tariffs could still be implemented under different legal authorities.

We strongly recommend that all importers ensure their ACE Portal account is active and that the ACH Refund Authorization form is completed to avoid delays should refunds become available.

We are closely monitoring developments and will provide updates as soon as formal guidance is released.
